Terms of Service

- Use the platform only for lawful purposes. You are responsible for your account and your content.
- We own our software. You own your content. Both keep their rights.
- Monthly plans bill on your upgrade date. Cancel by email within thirty days for a pro-rata credit.
- Texas law governs. Disputes go to Travis County. Class actions are waived.
- Cancel or ask questions any time at support@acceptanceone.net.

These Terms of Service (the "Terms") govern your access to and use of AcceptanceOne's platform, websites, APIs, and related services (collectively, the "Services"), provided by AcceptanceOne Inc and its affiliates ("AcceptanceOne", "we", "us", or "our"). By creating an account or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.
1. Account Responsibility & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at security@acceptanceone.net if you become aware of any unauthorized access.
AcceptanceOne cannot and will not be liable for any loss or damage arising from your failure to provide us with accurate information or your failure to keep your password secure.
2. Appropriate Conduct
You agree to use the Services only for lawful purposes and acknowledge that you are responsible for your own content. AcceptanceOne reserves the right to suspend or terminate accounts without disclosure of supporting details when we determine, in our sole discretion, that use of the Services violates these Terms, applicable law, or the rights of others.
3. Privacy & Data Access
AcceptanceOne may access and disclose account information when required by law or to address fraud, security issues, or legal violations, as outlined in our Privacy Policy. Your use of the Services is subject to the terms of that Policy, which is incorporated into these Terms by reference.
4. Intellectual Property
AcceptanceOne retains all proprietary rights to its software, platform, APIs, documentation, and services. Nothing in these Terms transfers ownership of our intellectual property to you.
You retain rights to the content you submit to the Services, but you grant AcceptanceOne a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content solely to provide, maintain, and improve the Services. This license terminates when you delete the content or close your account, except to the extent that the content has already been shared with others or is required to be retained by law.
5. Prohibited Uses
You may not use the Services to:
- Engage in illegal activities or facilitate illegal activities by others;
- Send spam or unauthorized commercial communications;
- Attempt to gain unauthorized access to any account, system, or network;
- Reverse engineer, decompile, or disassemble any portion of the Services except as expressly permitted by law;
- Harass, threaten, or harm any person or entity;
- Infringe on the intellectual property rights of AcceptanceOne, other users, or third parties;
- Interfere with or disrupt the integrity, security, or performance of the Services;
- Circumvent or attempt to circumvent any usage limits or security controls.
6. SMS & Text Messaging Terms
The Services may send SMS or text messages including invoices, reminders, and confirmations. You can opt out of non-transactional messages at any time by replying STOP to any AcceptanceOne message. Message and data rates may apply.
Delivery and deliverability of text, MMS, or SMS messages are not guaranteed by AcceptanceOne.
7. Payments & Refunds
Monthly subscriptions are billed on the date of your upgrade. You have thirty (30) days after any renewal to request cancellation with a pro-rata credit for the unused portion. Transaction fees and processing fees are non-refundable.
You are responsible for keeping your payment method up to date. Failure to pay any amounts when due may result in suspension or termination of the Services.
8. Cancellation & Termination
You may cancel your account at any time by emailing support@acceptanceone.net. Access will be removed within 72 hours of a valid cancellation request. AcceptanceOne reserves the right to terminate accounts for any reason, including breach of these Terms or extended inactivity.
Upon termination, provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, limitations of liability, and governing law) will remain in effect.
9. Disclaimers & Limitation of Liability
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted or error-free operation. AcceptanceOne disclaims all warranties for service interruptions, errors, or third-party conduct.
To the maximum extent permitted by law, AcceptanceOne's total aggregate liability arising out of or relating to these Terms or the Services is limited to the greater of (a) the amount you paid AcceptanceOne for the Services in the six (6) months immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).
AcceptanceOne is not liable for any indirect, incidental, consequential, special, or punitive damages, including without limitation loss of profits, revenue, or data, even if advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold AcceptanceOne, its affiliates, and their officers, directors, employees, and agents harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys' fees) arising out of or related to (a) your use of the Services; (b) your content; (c) your violation of these Terms; or (d) your violation of any law or the rights of a third party.
11. Governing Law & Disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction and venue in those courts.
Class action waiver: You and AcceptanceOne agree that any claim will be brought in an individual capacity only, and not as a plaintiff or class member in any class, collective, or representative proceeding.
12. Changes to These Terms
We may modify these Terms from time to time. Material changes will be communicated by posting the updated Terms on the AcceptanceOne site, updating the "Effective date" above, and, for significant changes, by email or in-product notification. Continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
13. Entire Agreement
These Terms, together with the Privacy Policy and any additional order forms or written agreements you enter into with AcceptanceOne, constitute the entire agreement between you and AcceptanceOne regarding the Services and supersede any prior agreements or communications on the subject.
If any provision of these Terms is held to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
